1. Welcome to NexStorez

Thanks for choosing NexStorez! These Terms and Conditions outline the rules and regulations for using our ecommerce platform. By signing up for an account and creating your store, you agree to play by these rules. If you don't agree with any part of these terms, we kindly ask that you do not use our services.

2. Your Account & Responsibilities

When you create a store on NexStorez, you are entirely responsible for what happens under your account. This means:

• You must provide accurate and up-to-date information during signup.
• You are responsible for keeping your password secure. Don't share it with anyone you don't trust.
• If you suspect someone has unauthorized access to your store, let us know immediately.

3. Your Store, Your Rules (and Liability)

We provide the software, but the store is yours. You own all the content, products, and customer data you upload to NexStorez. However, with great power comes great responsibility:

• We do not pre-screen your products. You must ensure what you sell is legal in your operating regions.
• You are solely responsible for handling customer service, shipping, returns, and complaints for your own buyers.
• We reserve the right (but not the obligation) to suspend your store if you are found selling illegal goods, engaging in fraud, or violating copyright laws.

4. Subscriptions and Billing

NexStorez provides a 7-day free trial for new users. After the trial period ends, you must subscribe to a paid plan to keep your store active.

• Frozen State: If a subscription is not renewed or a payment fails, your store will be placed in a "Frozen" state. You will retain access to your dashboard, but your public storefront will be disabled.
• Automatic Billing: By subscribing, you authorize our payment processor (Lemon Squeezy) to charge your payment method on a recurring basis.
• Pricing Changes: We reserve the right to modify our subscription fees with a 30-day prior notice.

5. Limitation of Liability

NexStorez provides the infrastructure for your store, but we are not responsible for your business operations. Under no circumstances shall NexStorez be liable for:

• Loss of profits, revenue, or data resulting from service interruptions.
• Any disputes between you and your customers regarding products, shipping, or refunds.
• The legality or quality of the products sold through your store.

6. Account Deletion & Restoration Policy

You can request to delete your store at any time from your dashboard. Upon approval of your deletion request, the following billing and data protocols apply:

• Immediate Subscription Cancellation: Your active subscription will be immediately canceled at the payment gateway level to ensure no future automated billing occurs.
• No Refunds (Forfeiture): If you delete your account before the end of your current billing cycle, you will not receive a prorated refund for the remaining days.
• Post-Restore Status: If you decide to return and restore your deleted account in the future, your store will be recovered in a "Frozen" state. Your previous premium plan will not carry over, and you will need to subscribe to a new plan to reactivate your store.
• We also reserve the right to suspend or terminate your account without prior notice if you severely breach these terms, engage in fraudulent activities, or harm the reputation of our platform.

7. Data Ownership and Intellectual Property

Your Content: You retain all ownership rights to the products, images, and data you upload to your store. By using NexStorez, you grant us a limited license to host and display this content to facilitate your store's operations.

Our Platform: All software, designs, and technology used to provide NexStorez (including subdomains and system architecture) remain the exclusive property of NexStorez.

8. Governing Law and Jurisdiction

Although NexStorez provides services globally, these Terms of Service shall be governed by and construed in accordance with the laws of Bangladesh. Any disputes arising under or in connection with these Terms shall be subject to the exclusive jurisdiction of the courts located in Bangladesh, without regard to its conflict of law provisions.
